User Agreement BOT Service Policy - Transfer of Room Ownership: The purchase of the BOT applies to the original room owner ONLY (the person that originally requested/paid for the services). Any conveyance, sale or other transfer of the room will incur new setup of $19.95. This means that room owners who no longer want their room but yet have a BOT can no longer hand off their bot to the new room owner. There will be a transfer fee charged to the new owner. If the new owner can not pay the transfer, then the BOT will go offline. BOTs will no longer be handed off to someone else like chat rooms are. This creates a lot of work on ShadowBots end at times with new room owners wanting to change room names and training issues. - BOT Nicknames: NO bots will be created if the customer purchases a Basic IRC Access for a bot that has the letters "TC", or Talkcity, in any form, in the bots nickname. Customers will be responsible for making the proper changes if this event takes place. - Script Services: NO scripts are sold. All scripts used are open source (meaning they are free for anyone to use). Size of the eggdrop bot files determines the price of a bot and the use of bandwidth. You are not buying scripts, you are buying Shadowbots services for building the bot, hosting them and maintaining and training bot owners and their ops. - Eligibility for Services: Customers who wish to purchase our services must be over 13 years old. Customers who wish to use our services must pay directly to ShadowBots. Customers shall not send payment to a third party to pay for their services, this includes forwarding money to friend, spouse, relative or other. If you cannot pay ShadowBots directly online you may send a money order. Those under the age of 18 need parents permission if they have to use their parents payment sources. Must be confirmed by phone. - Threats and Harassment: Customers who threaten or harass ShadowBots staff and or server in any way shape or form will be denied services, including termination of services immediately with no refunds and no future renewals. Customers who threaten to hack or harm ShadowBots server or staff will be terminated immediately with no refunds or future renewals and will be reported to law enforcement. - Security of Services: Customers who use ShadowBots services shall not give their passwords to anyone, including passwords to their nicknames they registered on a chat server that would give others access to their bot ownership flags. This is a security breach of services and will terminate your services immediately with any action taken by staff may include suspension or termination of services with no refunds. You consent not to breach or attempt to breach the security of ShadowBots web site. Obstructing the proper functioning of this web site or any activity conducted on this web site is strictly prohibited. Activities that may breach ShadowBots security measures or obstruct the web sites service include, but are not limited to: .. Sending viruses to the Web site, .flooding,. .spamming,. .mailbombing,. .crashing. or overloading the web sites server .. Sending unsolicited e-mail .. Logging onto a server or account and accessing data without authorization .. Probing, scanning or testing the web sites network or system for any vulnerabilities without authorization ShadowBots will seek to prosecute any customer who breaches the security of our web site or obstructs its proper functioning in any manner, including termination of services. - Downtime / Outage (Unplanned) Policy: A. Members should not join #bots - post - or private message any staff. B. TalkCity: Members should get latest update by typing /topic #bots or by joining our forum to see what the topic is in the chat-now box. Other Servers: ShadowBots System Status. C. ShadowBots will NOT issue an ETA. ShadowBots know when your BOT goes down - there is no need to come tell us. Having everyone come tell us ties our hands from trying to fix the problem quicker for everyone. ShadowBots reserve the right to pull your bot for 24hrs if you fail to comply with this policy. - Downtime / Outage (Planned) Policy: A. ShadowBots will warn you of planned outages. B. Members should get the latest update by typing /topic #bots or by joining our forum to see what the topic is in the chat-now box. Other Servers: ShadowBots System Status. C. Topic will have an ETA only if available. D. Members should allow up to one hour before posting or joining bots (No PrvMsgs). - Forum Posting Policy: Members should NOT post any rude/childish remarks or start a flame war on our forum and/or Support System tickets. Failure to comply with this policy will result in a 30 day forum gag. - Bot-Owners Responsibilities: A. Make payments properly and on time. B. Bot owners should make their chatters aware not to join #bots and complain of any issues. It'll be your responsibility to report to us. C. ShadowBots never make a change to your bot or add an OP when your chatters or assistants request it - Most chatters do this when the bot owner is out of town. If you wish to have your assistants request anything you must give us written permission via email. D. Do not kick the bot out of the room. E. Do not use the bot for illegal activities. F. You must keep the bot Op'ed at all times. (Assistant Manager Flag). G. Do not close nor rename your room without giving us 24hrs notice or your bot will go missing. (Requires rename fee). H. Making sure all scripts you purchased are installed and working before 7 days of purchase to make the sale final. Failure to follow above rules can result in loss of bot. Banning bot owner (Dawnstar) will block her from working on bots and may cause your bot to be removed with no refund. - 30% Refund Policy: If your not satisfied within three (3) days of purchase you may request a refund. (Refunds are only paid back in 30% due to labor work) Refunds are not issued if any of this agreement is broken. (We will not issue a refund if your bot isn't working correctly or stops working. ShadowBots will be glad to fix it as soon as possible at no charge.) If you purchase a rental and don't contact us to set it up within 10 days no refund will be issued but once you contact us we will be on the way to install your bot. - Service Fees: .. Need to move your bot to a new room? There is a $13.75 fee for us to remake your bot to set these new changes. [AVOID by: Thinking things over and make it your final decision on your first bots nickname and your room name before purchasing.] Remove Script: ShadowBots will remove a script you no longer want free of charge or exchange as a fair trade, after 7 days from purchase date there will be a $5.00 fee. [AVOID by: Testing the scripts in our #bot room before you purchase.] SetUp Fee: Set up fee is normally $15.00 and is FREE for TalkCity members. IRC Access Fee: If you're using the bots on TalkCity.com, you're responsible for paying the $7.77 IRC access fee. Once you pay for the bots IRC access and decide you no longer want it, TalkCity will not allow it to be transferred back to you or any other nickname. ShadowBots cannot install the bot until TalkCity staff sets the IRC access up. ShadowBots has no control over it. Training Classes: When you purchase a bot you'll get FREE Training and can attend Training classes with other bot owners FREE. Special Training Class: If you wish to set up a special training class for you and your own room instead of joining classes with other bot owners you can pay $10.50 and ShadowBots will set a time and date to meet with you in your room for 1 hour. [AVOID by: Joining our FREE Training Classes made for all owners.] Reconnect Fee: If you have renamed/closed room without giving us 24 hour notice there will be a $10 reconnect fee. (An additional $13.75 fee may apply if room name is changed.) [AVOID by: A.) Giving 24 hour notice B.) $13.75 rename fee paid up front plus 24 hour notice.] Re-Install Fee: You must let server admin or server owner be aware that you plan to get a bot put in. As some server operators have banned our bots causing it to be recreated. I.E. Some servers have a huge sign up process to create a nickname and login via IRC set a pass and identify the bot via nickserv - This is a lot of work on our end to redo it all therefore there is a $15.00 (Re-Install/Reconnect Fee). - Gift Policy: You may purchase a bot for another room owner only if ShadowBots approves it. Contact us if you plan on doing this - If you purchase a bot for another room owner as a gift - That room owner officially becomes the full owner of the bot and its IRC access in 7 days. After 7 days you cannot request that we give the Bot and IRC access back to you. - Payment Policy: A. Personal Checks Accepted. B. Money Order Accepted. C. Pay Pal Payments and E-check Accepted. D. E-checks must wait till cleared (4-7 Business Days). - Our Advertisement Right: ShadowBots has the right to advertise our service. I.E. When you join the room the bot will PM you this: Welcome to #Roomname, If you are in need of your own IRC BOT Visit http://www.shadowbots.com/ - Pricing: How ShadowBots charge - How much space/bandwidth is needed to run all scripts on our server - ShadowBots DOES NOT SELL SCRIPTS! - Services: ShadowBots reserves the right in its sole discretion to modify or discontinue the Service if you misuse the bot by continuing to violate the rules. ShadowBots reserves the right to refuse to do business/sell/rent out products to anyone at anytime. - Privacy Statement: ShadowBots uses a standard log to measure traffic on its Web site. The log collects technical and general information about online traffic, including Internet Protocol (.IP.) addresses, commonly-used browser types, number of hits, popular pages, commonly-used operating systems. These types of technical and general information contain no personally identifiable components. Information about our online guests is collected for the common purposes of communicating with our guests through e-mail and other means, providing quality customer service to guests who contact us, improving the features of our web site and Services. What you do in your own chatroom, forum is your own "business". ShadowBots will not monitor, log or spy in any way shape or form. ShadowBots does help its members on request, to help stop a problem chatter. While our bots have A Flag (Assistant Manager) ShadowBots will not go in your 'controls' via TalkCity unless giving permission from its members. Because TalkCity has flag levels on moderator powers our bots need Assistant Manager flags on TalkCity to allow C Flag (Chat Moderator) to use the bots OP and DEOP features. Stream Service Policy You understand that you are entirely responsible for your stream, stream content, and/or streamers. You understand that at time of purchase of a stream you must become an active subscriber of the Stream Mailing List. You agree to not use this service to: a.) play content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; b.) stalk or otherwise harass another. You understand that this service will NOT: a.) provide sounds, and/or music b.) provide streamers (those that will play music for listeners) c.) train streamers - Stream Owner Responsibilities: A. Make payments properly and on time. B. Stream owners should make their chatters aware not to join #bots and complain of any issues. It'll be your responsibility to report to us. Failure to follow above rules can result in loss of stream. [Image Uploading Service] You understand that all materials ("content"), whether it is publicly posted or privately transmitted, are the sole responsibility of the person from whom such content originated. This means that you, and not Dawnshosting, are entirely responsible for all content you upload or otherwise make available via this service. Under no circumstances will ShadowBots be held liable in anyway for any content, including, but not limited to, any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via this service. You agree that you are entirely responsible to save backup copies of all content that is uploaded. You agree to not use this service to: a.) publish, post, distribute or otherwise disseminate unlawful material or information including, but not limited to: threatening, abusive, tortuous, libelous, racial, ethnically, harassing, defamatory, obscene, or fraudulent information and materials, or proprietary, copyrighted, or otherwise intellectually protected information and materials for which Customer does not have authorization or authority to possess or distribute. b.) The Service must not be used to request unlawful services or materials. c.) The Service must not be used for activities Dawnshosting deems to impact its customers or its ability to deliver services to its customers. Such activities may include, but are not limited to; The distribution of child pornography or any obscene, abusive, defamatory or threatening speech or material. d.) You may not host any images containing adult oriented content, including nudity of any kind. Any activity infringing on the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, and patents. - Image Hosting Owner Responsibilities: A. Make payments properly and on time. B. Image Hosting owners should make their chatters aware not to join #bots and complain of any issues. It'll be your responsibility to report to us. Failure to follow above rules can result in loss of hosting. General Information - Entire Agreement This AGREEMENT between ShadowBots, Inc. Inc. (hereinafter referred to as "ShadowBots") and Account Holder (hereinafter referred to as "Customers", "you", "your", and "members") The User Agreement constitutes the entire agreement between you and ShadowBots/Dawnshosting and governs your use of the Service, superseding any prior agreements between you and ShadowBots/Dawnshosting with respect to the Service. The User Agreement terms, in whole or part, cover any transaction between the customers who use any ShadowBots service. You agree that ShadowBots may, under certain circumstances and without prior notice, immediately terminate your account, and any access to the service. Cause for such termination includes, but not limited to, (a) breaches of violations of this User Agreement or other agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletion), (d) engagement by you in fraudulent or illegal activities, and/or (f) nonpayment of any fees owed by you in connection with the services. Termination of your account includes (a) deletion of your password and all related information, files and content associated with or inside your account, (b) barring of further use of the service. We reserve the right to modify this user agreement and privacy statement at any time without notification. Any contact that needs to be done between you and Dawnstar may be done through the Support Ticket which is located here: http://shadowbots.com/hesk. - Mailing Lists It is required by all customers who use any Shadowbot service to be an active member in the current mailing list. The purpose of the mailing list is to keep the customers up to date on all services. It is important that the email address is valid and working for customers to receive these types of communications. - Late Payments In an effort to help our customers avoid unintentional removal/deletion of their BOT/Stream, we may, but are not obligated to, provide our customers with a .grace period. after their services expiration date(s) (a .grace period. begins on the day after the date of expiration). We currently endeavor to provide a grace period that extends 5 days past the expiration date, to allow the renewal of services, after that the service will be terminated without any advanced warning. A reconnection fee of $9.95 must be paid thereafter. Due dates are posted to BOT/Stream owners atleast a month in advance, and notices are also sent to remind you. (Prior arrangements can be made) - Auto Renew You agree that by using this feature (Auto Renew) that you give prior authorization to transfer the amount required each month from your account to ShadowBots to make your payment. Auto Renew will be initiated as long as there are funds in a customer account or a valid credit card on file in a customer account. Any renewal of your services with us is subject to our then current terms and conditions and payment of all applicable service fees at the time of renewal.
